These Terms of Service ("Terms") govern your access to and use of the websites, software, and services provided by Binary Core LLC ("Binary Core," "we," "us," or "our"), including binarycore.us, the BowerBot open-source project, and the CytoLens platform. By using any of our services, you agree to these Terms. If you do not agree, do not use the services.
1. Our Services
Binary Core LLC is a San Diego, California company that builds 3D and AI technology. These Terms cover the following services:
- binarycore.us: our marketing website, including contact forms and informational content about Binary Core and our work.
- BowerBot: an open-source command-line AI agent for OpenUSD scene assembly, distributed under the Apache 2.0 license.
- CytoLens: a web-based medical AI platform for thyroid cytology analysis, currently used for research and clinical validation.
We may add, change, or discontinue features at any time. We will provide reasonable notice for material changes that affect active users of CytoLens.
2. Eligibility and Accounts
You must be at least 18 years old and capable of forming a binding contract in your jurisdiction to use our services. If you use our services on behalf of a company, hospital system, or other organization, you represent that you have authority to bind that organization to these Terms.
Where an account is required (for example, for CytoLens), you are responsible for maintaining the confidentiality of your credentials and for all activity on your account.
3. BowerBot Terms
BowerBot is open-source software provided under the Apache License, Version 2.0. The Apache 2.0 license text accompanying BowerBot's source code is the authoritative license and governs your rights to use, modify, and redistribute the software.
As-is and no warranty
Consistent with the Apache 2.0 license, BowerBot is provided "AS IS" and without warranty of any kind, whether express or implied. Binary Core makes no warranty regarding fitness for a particular purpose, accuracy, reliability, or non-infringement of BowerBot or any outputs it produces.
Your API keys and costs
BowerBot relies on third-party AI providers such as Anthropic and OpenAI. You are solely responsible for obtaining and securing your own API keys for those providers, for complying with those providers' terms, and for any usage charges, rate limits, or other costs incurred under your account with those providers. Binary Core does not bill for BowerBot usage and does not pay for your third-party API usage.
No liability for outputs
BowerBot produces outputs (for example, scene files, code suggestions, and natural language text) using third-party AI models. Binary Core does not guarantee the correctness, completeness, or suitability of those outputs. You are responsible for reviewing and validating any output before using it in production.
4. CytoLens Terms
Important medical notice. CytoLens is provided for research and clinical-validation purposes only. CytoLens is not FDA approved, has not been cleared as a medical device, and is not a substitute for professional medical judgment. CytoLens output must not be used as the sole basis for any clinical decision.
Clinical responsibility stays with qualified professionals
All clinical decisions regarding diagnosis, treatment, follow-up, and patient care remain the sole responsibility of the qualified medical professionals reviewing each case. CytoLens is an assistive analysis tool and its output should be interpreted alongside standard clinical workflows, independent professional judgment, and applicable standards of care.
Authorized users and institutional data handling
Access to CytoLens is limited to authorized users at participating institutions. You agree to use CytoLens only in accordance with your institution's policies, applicable law (including any patient consent and privacy requirements such as HIPAA), and any written agreement between Binary Core and your institution.
No warranty; research-grade software
CytoLens is provided as research-grade software on an "AS IS" and "AS AVAILABLE" basis, without any warranty of any kind, whether express or implied. We make no warranty of fitness for a particular purpose, diagnostic accuracy, or uninterrupted operation.
5. Acceptable Use
You agree not to use any Binary Core service to:
- Violate any law or regulation, or infringe anyone's rights (including intellectual property, privacy, or publicity rights).
- Create, distribute, or attempt to generate illegal content, including content that sexually exploits minors, content that incites violence, or content that constitutes harassment or unlawful discrimination.
- Abuse, overload, or circumvent the limits of any third-party AI API (including Anthropic, OpenAI, or any other provider) reached through BowerBot, or use those APIs in violation of their terms of service.
- Attempt to probe, scan, reverse engineer, or circumvent the security of our services, except as expressly permitted by the Apache 2.0 license for BowerBot source code.
- Upload malicious code, attempt to disrupt service operation, or interfere with other users.
- Use CytoLens for patient care in a manner inconsistent with its stated research and clinical-validation purpose, or in a way that violates HIPAA or other applicable health privacy law.
6. Intellectual Property
All content on binarycore.us and all software comprising CytoLens (including the trademarks "Binary Core," "BowerBot," and "CytoLens") are owned by Binary Core LLC or its licensors, except for content you provide.
BowerBot's source code is licensed under the Apache 2.0 license, the terms of which govern your rights in the BowerBot code itself. This Section does not restrict those rights.
You retain ownership of content you upload to CytoLens (subject to any institutional agreement). You grant Binary Core a limited license to process that content as needed to operate the platform and to provide the service you requested.
7. Privacy
Our Privacy Policy describes how Binary Core handles information across binarycore.us, BowerBot, and CytoLens. By using our services, you agree to the practices described in the Privacy Policy.
8. Disclaimers
To the maximum extent permitted by law, Binary Core LLC provides its websites, BowerBot, and CytoLens on an "AS IS" and "AS AVAILABLE" basis. Binary Core disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.
We do not warrant that our services will be uninterrupted, timely, secure, or error-free, nor that any output produced by our services (including BowerBot outputs and CytoLens analyses) will be accurate, complete, or fit for any particular purpose.
9. Limitation of Liability
To the maximum extent permitted by law, in no event will Binary Core LLC, its affiliates, employees, contractors, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including (without limitation) lost profits, lost data, loss of goodwill, business interruption, or any clinical, diagnostic, or treatment decision made by any person, arising out of or relating to the services, BowerBot, CytoLens, or these Terms, whether based on contract, tort, statute, or any other legal theory, even if Binary Core has been advised of the possibility of such damages.
In no event will Binary Core's total aggregate liability arising out of or relating to these Terms or the services exceed the greater of one hundred U.S. dollars ($100) or the amount you have paid Binary Core for the specific service giving rise to the claim in the twelve months preceding the event that gave rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent any such limitation is not enforceable in your jurisdiction, the limitation will apply to the maximum extent permitted by applicable law.
10. Indemnification
You agree to defend, indemnify, and hold harmless Binary Core LLC and its affiliates, officers, employees, and contractors from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of your use of the services, your content, your violation of these Terms, or your violation of any law or third-party right.
11. Termination
We may suspend or terminate your access to our services at any time if you violate these Terms or if we reasonably believe continued access creates a risk to us, to other users, or to the integrity of the service. You may stop using our services at any time. Provisions of these Terms that by their nature should survive termination (including Sections 6, 8, 9, 10, 12, and 13) will survive.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or our services will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction and venue in those courts.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the services after an update constitutes acceptance of the revised Terms.
14. Miscellaneous
These Terms, together with the Privacy Policy and any license that accompanies BowerBot or any written agreement between Binary Core and your institution for CytoLens, constitute the entire agreement between you and Binary Core regarding the services. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these Terms without our written consent; we may assign them freely.
